An interesting article on physician expenditures and malpractice claims

Yes - the courts do not necessarily get the big picture. They hear about diagnoses that tests that were not clinically indicated in the context might have picked up (we all remember examples of these), but not the patients damaged by unnecessary testing!

Yeah, that was a little depressing, if not necessarily unexpected.

What would be a lot more interesting and useful, but also much harder to design:  a study of correlation between "smart/appropriate" diagnostic testing and malpractice claims.  In other words, was the malpractice reduction in the BMJ study due to shotgun/low pretest probability testing, or due to more thorough diagnostic process, or both.
